Section 1: Introduction
We are Amani Ya Juu Foundation Registered Trustees (Amani Ya Juu) and Amani Garden Cafe unless otherwise stated.
Section 2: Definitions
2.1 “Agreement” references these Terms and Conditions (T&Cs), the Privacy Policy any payment instructions provided to you and any other form we might provide to you.
2.2 By “Privacy Policy” we mean the policy accessible on our websites which details how we collect and store your personal data.
2.3 “You” “your” and “yours” are references to the person accessing this website, and placing orders for the Goods or Services we display on it, access through any other channel provided by Amani Ya Juu Foundation or Amani Garden Cafe will also bound you to these terms and conditions.
2.4 “We” “us” “our”, and “Amani Ya Juu Foundation or Amani Garden Cafe are references to the company.
2.5 “Goods” is a reference to any goods which we may offer for sale from our website at a given time.
2.6 “Service” or “Services” is a reference to any service which we may supply and which you may request from our website or from our Garden Cafe delivery service.
2.7 “Garden Cafe Food Delivery” references perishable goods and any form of delivery service of which we take full responsibility.
2.8 “website” is a reference to our website or any other platform we choose to offer our goods and services.
Section 3: Product Descriptions
3.1 Each product on our website is described as accurately as possible and we take care to ensure all details, descriptions and prices of products appearing on our website are correct at the time when relevant information was entered into the system. Although we aim to ensure our website is as up to date as possible, the information, including Product Descriptions, appearing  on the website at a particular time may not reflect the position at the exact time an order is placed.
3.2 Although every effort is made to ensure that the goods purchased are 100% as described and free of damages and defects, due to the handmade nature of our products, there may be variations in the materials used or the finish due to avail of materials used. Minor imperfections or variations are to be expected in certain pieces and will not be deemed as defects, or reason for return.  Approximate measurements of products are quoted on our website and your failure to take note of the size of a product will not be deemed as a reason for its return.

Section 4: Ordering
4.1 All items remain the property of Amani Ya Juu Foundation Registered Trustees until payment has been made in full.
4.2 Amani Ya Juu Foundation reserves the right to refuse to sell any goods or services.
4.3 Payments can be made via mobile money or by debit card or credit card payments.
4.4 Amani Ya Juu holds stock of all items, and has a policy to dispatch within 5-7 working days receiving your order. If for any reason, there is likely to be a delay, we will contact you with the details.
4.5 Under no circumstances can we be held liable or accountable for failed deliveries through inaccurate address details provided to us by a customer. It is the customer’s responsibility to check details thoroughly both at the time of order and in the order confirmation.
4.6 To cancel your order, you must notify us in writing before the end of 2 working days.
4.7 Amani Ya Juu has a no refund, exchange only, policy within 7 days of purchase for non-perishable products.  We can not offer an exchange on pierced-earring jewelry due to hygienic requirements.  The tags must be attached to the products and the original receipt must be presented with the date of purchase.  For Amani Garden Cafe deliveries, sales are final for perishable products, no refunds or exchanges will be made.
4.8 In the unlikely event that your item reaches you faulty or damaged, we will be happy to take it back and refund your money.  Please wait until you have spoken to our Customer Care team before returning anything to us.  Please have an image of the faulty item ready for when you speak to us.  Amani Ya Juu reserves the right to refuse exchanges where it is deemed by us that product misuse has occurred or the item has been used. An item claimed as faulty must be returned to us for testing, and in the event that no manufacturing defect is present, the item will be returned to you. All exchanges are to be brought to the Amani Ya Juu physical store.
4.9 You have up to 7 days after dispatch of your order to inform us via our customer care of any items not received. After this time, it is difficult for us to trace packages so we cannot be held responsible.

Section 5: Pricing and Availability
5.1 All products are subject to availability.
5.2 Amani Ya Juu reserves the right to change any product price before you place an order.
5.3 Amani Ya Juu reserves the right to cancel orders where incorrect pricing has been listed.
5.4 Amani Ya Juu reserves the right to update these Terms and Conditions at any time.
5.5 Prices are inclusive of VAT and are shown in Kenya Shillings.

Section 6: Meals & Allergies
6.1 Allergies Advice: If you have a food allergy, intolerance, or sensitivity, please be advised that food prepared here may contain these ingredients: dairy, eggs, wheat, cereal, soybean, peanuts, tree nuts, sesame seeds, poppy seeds, mustard, fish, and sulphites. While we take the utmost care in preparing our dishes, due to our operations & shared cooking equipment, we cannot guarantee you that these ingredients would not have come into contact with your dish. Neither staff nor managers can alter this advice or assure otherwise.

Section 7: Delivery

All Gift Shop purchases are delivered using Fargo delivery services.

  1. How long to pick from Amani?  By end of day or next day (depends time of call)
  1. How long to deliver?   Within Nairobi -- overnight (1-2 days).  Outside Nairobi (2-3 days).  Asterick (3-4 days)
  1. Tracking of my delivery?  Both Amani and Customer can track package. Tracking number is provided for tracking package on Fargo website.  Link for Fargo tracking below: 

  1. Amani provides door to door delivery (in most cases) through Fargo.
